Touch of woman's nipple during massage left her 'disgusted'

A WOMAN was "embarrassed", "upset" and "disgusted" when she was groped during a full body massage.

Judge Brian Devereaux labelled it a "significant breach of trust".

The woman, who wasn't from Mackay, had paid for a one-hour full body massage.

During the treatment, Chen, 38, had asked the woman to turn onto her back and he left the room while she did, crown prosecutor Matthew Hynes said.

A towel covered the woman's breasts and groin area. Chen massaged her stomach before he slid a hand under towel and "momentarily" touched her left nipple, Mr Hynes said.

It was deliberate and it made her feel very uncomfortable, Mr Hynes said.

She stayed for the remainder of the massage before going directly to police.

Chen, now 39, pleaded guilty to one count of sexual assault.

Defence barrister Paddy Cullinane, for Macrossan and Amiet, said his client was "a man with no criminal history".

"The actions of Mr Chen amount to an aberration," Mr Cullinane said.

Chen was born in China and made Australia his home in 2005. He officially became a citizen in 2008 and had owned the massage business for seven months prior to when the offence occurred.

Chen's bail conditions restricted him from acting as a masseur in the past 13 months, but there were (and currently are) no professional restrictions by the Massage Association of Australia.

The District Court in Mackay was told the actual offending was at the lower end.

Mr Cullinane argued strongly against the recording of a conviction.

"I don't know that a conviction will have any impact... (on) him running a business," Judge Devereaux said.

"I consider the offence as so serious that it should be recorded."

Chen was convicted and fined $6000.
