Judge rules in favour of public servant over sex injuries

A COMPENSATION claim for injuries sustained during sex on a NSW work trip, has made it all the way to the High Court of Australia.

For five years, a Canberra-based public servant has been battling it out with Comcare over an unfortunate one-night stand in a motel room which had been paid for by her company.

During the first hearings, the Federal Court heard the woman and a man she had met a Nowra, were "going hard" when a glass light fitting came away from the wall and cut her nose and mouth.

Eventually, the judge's decision went in her favour, but before damages were awarded Comcare launched an appeal.

Fairfax reported Commonwealth solicitors are arguing the woman was not covered by a workers compensation scheme because sex was "in every sense a personal choice" and not part of her work duties.
